What is Bail?

Knowing When Bail Bonds are Not An Option

Keep in mind that bail bonds are generally not available if an individual is subject to a hold or detainer placed by a court or government agency other than the arresting court. Such holds are generally placed on individuals who have outstanding warrants in other areas. Individuals who have chronically failed to pay traffic tickets may also be held in jail until all fines are paid.

Remember that individuals are only eligible for bail if the court has set bail. In some cases, the court will not set bail and an individual will remain in jail until the time of trial.

The Bail Bond Process

Thankfully, many individuals who have been arrested can get out of jail with a bail bond. In order to be freed on bail, the bondsman must deliver to the court the required amount of bail for your release.  The individual or family must also provide collateral that proves that the remainder of bail can be paid should the individual fail to show up in court.

Arresting and Pre-Booking: The Early Stages

Immediately after an individual has been arrested, they go through a process called booking. The booking process itself can take several hours. This is the period of time during which a suspect is searched, photographed and given the opportunity to make a statement. A suspect’s personal belongings will be taken away at this time.

Individuals who are then booked on basic charges may have bail automatically set. At this time, the individual will be allowed to make a call to a family member, lawyer or bail agency. Many family members will attempt to gather the money to put up bail on their own or will contact a bail bond agency at this time.

Obtaining A Bail Bond

Once the arrest and booking process is complete, the bail bond process can be started. In most situation, friends or family members of the individual who was arrested contact a bail bond agency for assistance. After we have gathered information, one of our professional bail bondsmen will walk you through the process of purchasing the bail bond. You will generally need to put up collateral and may need to make a payment equal to 10 percent of the bail. Once all bail paperwork has been completed, a representative of Bail Bond Shealy will post the bond with the applicable court. Individuals are generally freed within 24 hours after a bail bond has been posted.
